Terms of Service

By registering for, accessing or using the Platform, you confirm that you have read, understood and agree to be bound by these Terms and by our Privacy Policy. If you do not agree, you must not use the Platform.

You must be at least 18 years of age and competent to contract under the Indian Contract Act, 1872. By using the Platform you represent that you meet these requirements and that the information you provide is true and accurate.

OurGuests is a software platform that helps landlords and tenants manage properties, tenancies, rent, electricity billing, maintenance requests and related records. We are an intermediary and facilitator only. We are not a party to any tenancy or rental agreement between a landlord and a tenant, are not a real-estate broker or agent, and do not own, manage, or let any property. Any tenancy, rent, deposit or dispute is solely between the landlord and the tenant.

You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately of any unauthorised use. You may sign out of all devices from your profile settings.

Certain features are offered under paid subscription plans. Fees, plan limits and any promo-code discounts are shown on the Platform at the time of purchase and are exclusive of applicable taxes (including GST), which will be charged as required by law. Subscriptions renew as described at checkout unless cancelled. Except as required by law, fees are non-refundable.

You agree not to: use the Platform for any unlawful purpose; upload false, infringing, obscene or unlawful content; impersonate any person; attempt to gain unauthorised access to the Platform or other users' data; upload malware; or use the Platform in a way that infringes the rights of others or violates the IT (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021. We may remove content or suspend accounts that breach these Terms.

You retain ownership of the content and documents you upload. You grant us a limited, non-exclusive licence to store, process and display that content solely to operate the Platform for you. You are solely responsible for the content you upload and confirm that you have the right to upload it.

The Platform, including its software, design, logos and trademarks, is owned by OurGuests and protected by applicable intellectual-property laws. You may not copy, modify, distribute, or reverse-engineer any part of the Platform without our prior written consent.

The Platform is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, to the maximum extent permitted by law. We do not warrant that the Platform will be uninterrupted, error-free or secure. Any financial figures shown (such as balances or projections) are for convenience and do not constitute financial, legal or tax advice.

To the maximum extent permitted by law, OurGuests shall not be liable for any indirect, incidental, special or consequential damages, or for any loss of profits, data or goodwill, arising out of your use of the Platform. Our aggregate liability for any claim shall not exceed the amount paid by you to us, if any, in the twelve (12) months preceding the claim.

You agree to indemnify and hold harmless OurGuests and its proprietor, employees and agents from any claim or demand arising out of your breach of these Terms, your content, or your violation of any law or the rights of a third party.

You may stop using the Platform at any time. We may suspend or terminate your access if you breach these Terms or applicable law. On termination, your right to use the Platform ceases; certain records may be retained as required by law (see the Privacy Policy).

In accordance with the Information Technology Act, 2000 and the rules thereunder, complaints regarding the Platform or any content may be addressed to our Grievance Officer:

The Grievance Officer will acknowledge a complaint within 24 hours and endeavour to resolve it within 15 days.

These Terms are governed by and construed in accordance with the laws of India. Subject to the arbitration clause below, the courts at Jaipur, India shall have exclusive jurisdiction over any dispute arising out of or in connection with these Terms.

Any dispute that cannot be resolved amicably shall be referred to arbitration by a sole arbitrator under the Arbitration and Conciliation Act, 1996. The seat and venue of arbitration shall be Jaipur, India, and the proceedings shall be conducted in English.

We may amend these Terms from time to time. Material changes will be notified through the Platform, and your continued use after such changes constitutes acceptance of the revised Terms.
